General Terms and Conditions

Au Pairs Worldwide The Netherlands

1.These terms and conditions apply to all parties that register at Au Pairs Worldwide The Netherlands, therefore for the host family as well as the au pair herself or himself.
2.In these general terms and conditions a host family is every family that has registered at Au Pairs Worldwide The Netherlands as such, for the benefit of placing an au pair.
3. In these general terms and conditions an au pair is any person who has registered as such for the benefit of placement in a host family. Furthermore, an au pair in the general terms and conditions is any person who has registered as mothers help for the benefit of placement in a host family.
4.By registering at Au Pairs Worldwide The Netherlands the au pair agrees with the general terms and conditions.
5.By registering at Au Pairs Worldwide The Netherlands the host family agrees with the general terms and conditions.
6.The au pair and the host family, together and each separately, declare to be familiar with the fact that Au Pairs Worldwide The Netherlands places European as well as non-European au pairs in European as well as non-European host families. Therefore it might occur that a non-European au pair is placed in a non-European host family.
7.The au pair/hostfamily commits herself or himself by sending the by her or him signed registration forms to transfer the registration fee within ten days after that. The mediation fee is to be paid within ten days after the au pair/hostfamily has received a written confirmation from Au Pairs Worldwide The Netherlands, in which host family the au pair has been placed.
8.If the registration fee and the mediation fee are not to be paid within the dictated term, Au Pairs Worldwide The Netherlands reserves the right to hand the claim over to a third party. The resulting costs are to be paid by the au pair/hostfamily and come to a minimum of 15% of the money due, to be raised by the applicable added-value tax. A claim will also be made on the legal interest as meant in article 119 of book 6 of the Dutch civil code.
9.Although Au Pairs Worldwide The Netherlands has selected the host family and/or the au pair with the utmost care, Au Pairs Worldwide The Netherlands cannot accept liability in any way for possible damage, including damage resulting from a possible shortcoming and/or a proven misrepresentation, which has not purposely been caused by Au Pairs Worldwide The Netherlands.
10.In case of insurmountable difficulties between the au pair and the host family, Au Pairs Worldwide The Netherlands will make every effort to find a new host family for the au pair and/or to find a new au pair for the host family. However, no guarantees can be given on this matter. If an au pair should not be suitable two weeks notice must be given for termination of employment with the au pair.
11.If a by Au Pairs Worldwide The Netherlands selected host family decides to refuse an au pair, the host family is still indebted for the amount that they already have paid or had to pay.
12.If the by Au Pairs Worldwide The Netherlands selected au pairs decides to withdraw after she or he has accepted the host family, she or he is still indebted for the amount that she or he has already paid or had to pay.
13.All Au Pairs from NON EEC countries must register with your local police station for alien states.It is an offence not to register within 3 days.Apply for visa( MVV) and Registration is the responsibility of the Au Pair and the hostfamily and not the responsibility of the agency.
14. Au Pairs Worldwide The Netherlands cannot be obligated to contact the au pair who stays in The Netherlands or abroad, nor the host family, by phone,e-mail, telegraph, telex, fax or any other way without a reasonable cause.
15.The au pair and/or the host family will, in case of complaints, follow the procedure underneath:
a) When there is a complaint about the mediation of Au Pairs Worldwide The Netherlands during the stay with the host family, a written complaint can be filed at Au Pairs Worldwide The Netherlands. If a second (foreign) au pair agency has been brought in for the mediation, the complainer can choose to file his or her written complaint at this agency.
b) Au Pairs Worldwide The Netherlands will, in the case of a notification of a complaint, attempt to solve the problem on the spot.
c) The au pair must, in case of a complaint, prior to leaving the host family, place the complaint at one of the au pair agencies mentioned above. If after the au pair has left it turns out that no complaint has been filed Au Pairs Worldwide The Netherlands can no longer deal with any complaints concerning that matter.
d) The host family must, in case of a complaint, prior to the au pair leaving the host family, place the complaint at one of the au pair agencies mentioned above. If after the au pair has left it turns out that no complaint has been filed Au Pairs Worldwide The Netherlands can no longer deal with any complaints concerning that matter.
16.The family and the au pair are aware of the fact that the au-pair will be staying with the family on a social and cultural basis.In exchange for an allowance the au-pair will help the family by offering her services as described in Article 17.
17.For the allowance the au pair agrees to take care of the children of the host-family up to a maximum of 30 hours per week, in accordance with the values and standards of the host-family, therefore the family will give the au-pair a schedule.Furthermore the au-pair will take care of additional light housekeeping,such as a little cleaning,washing and ironing,shopping,preparing simple meals etc. The 30 hours per week have to be fulfilled within 5 days but not more than 8 hours per day. The au-pair is also expected to babysit for no more than 2 evenings per week,if required. The host-family, on their part, is obligated to give the au-pair 2 day's off per week and at least one whole week-end off per month.
18.It is stated, according to the guidelines set by the European Council, that the payment as agreed ,is considered to be an allowance and therefore not to be named as salary.Thus relieving the family of the duty to pay any taxes and/or premium for social security.The allowance paid on a monthly basis by the family will be for the amount of € 340,- maximal.
19.The hostfamily is responsible for providing room and board as well as the costs for health insurance for the au pair (including the costs not provided for by this insurance).
20.It is the hostfamily's responsibility to take out medical insurance for the au pair.
21.In addition to the allowance,the host-family agrees also to pay for:
Language course to be followed at an institution/a school chosen by the family for no more than € 240,- on a yearly basis.
22.During a period of 12 month's, the au-pair has the right to a leave of absence(holiday) of 2 consecutive weeks,during which period the allowance as agreed upon in Article 4,will continue to be paid.This holiday can not be taken sooner than after 6 months upon arrival. If both parties have agreed upon a stay shorter than 12 month's.The length of this holiday will be accordingly and only to be taken by the au-pair not sooner than after fulfilling at least 50% of the period of stay as agreed upon.
23.The social and cultural nature of the relationship between au-pair and host-family should be translated as followed: The family should give the au-pair the opportunity to experience national culture,visit museums,other cities,the zoo,etc. The au -pair also has to have the opportunity to meet other people and make new friends. During her free time, the au-pair has the right to do whatever she wants, of course within reason and not violating house rules.
24.The au pair is aware of the fact that she is allowed to reside with the host-family for a period of no longer than 12 month's and then to leave the country. Immediately after the agreement expires also if this agreement is ended sooner by one or both parties.
